DMCA & Copyright Policy

1. Our position

Santoram respects intellectual-property rights and expects its users to do the same. We respond to clear and complete notices of alleged copyright infringement under the United States Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512), Canada's Copyright Act notice-and-notice regime, and equivalent laws in other jurisdictions. We will terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

2. Designated agent

Only notices that meet the requirements below will be actioned. Misuse of this process may result in liability under 17 U.S.C. § 512(f) or equivalent local law.

3. Notice requirements

Your notice must include all of the following:

  1. A physical or electronic signature of the owner or a person authorised to act on the owner's behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works).
  3. The exact URL(s) on Santoram of the allegedly infringing material, sufficient for us to locate it.
  4. Your full name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or are authorised to act on the owner's behalf.

4. What we do with a valid notice

  • Remove or disable access to the material expeditiously.
  • Notify the affected user and forward a copy of the notice.
  • Record the notice for our repeat-infringer log.

5. Counter-notice

If you believe your content was removed in error or misidentification, you may submit a counter-notice to the same address containing:

  1. Your physical or electronic signature.
  2. Identification of the removed material and the location where it appeared before removal.
  3. A statement, under penalty of perjury, of a good-faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, plus a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if outside the U.S., the courts of Ontario, Canada), and that you will accept service of process from the original notifier or its agent.

If we receive a valid counter-notice, we may restore the material in 10 to 14 business days unless the original notifier files an action seeking a court order against you.

6. Repeat-infringer policy

Accounts that are the subject of repeated, valid notices of infringement will be suspended and ultimately terminated, at our sole discretion and without refund. See our Terms of Service and Acceptable Use Policy.

7. Trademark, publicity, and other rights

For trademark complaints, right-of-publicity claims, defamation, or other non-copyright rights issues, write to legal@santoram.com with the equivalent information: who you are, what right you assert, the legal basis, the URL of the content, and a signed statement of accuracy.

8. Bad-faith notices

Knowingly making a material misrepresentation in a notice or counter-notice may make you liable for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f) or equivalent local law. We may decline to act on, and may publish, notices that are abusive, automated at scale, or facially deficient.
